Woman in Her Thirties Faces Jail Time for Unfounded Accusations of Rape, Legal Measures Intensified

In a distressing turn of events, a woman in her early thirties has been sentenced to imprisonment after falsely accusing her biological father, who had generously funded her overseas education, of rape. Her actions were allegedly motivated by his refusal to provide her with financial assistance.

According to recent details from the legal arena dated the 1st, the Criminal Division 1 of the Namyangju Branch of the Uijeongbu District Court, under the stewardship of Presiding Judge Choi Chi-bong, rendered a 10-month prison sentence to the woman, referred to as 'A', on multiple charges, including defamation, hindrance of business operations, and insult.

The allegations trace back to a series of 11 online posts made by 'A' from May to June of the previous year. Under the sensational headline "I am a victim of familial sexual violence. Please look at this," she maliciously tarnished her father, identified as 'B'.

Within these posts, she spun an elaborate tale of abuse, claiming, "I have been continuously sexually assaulted by my biological father since I was four years old, and my mother also suffered domestic and sexual violence." She further alleged that the issue was resolved with 30 million won in damages and insisted that "severe punishment is necessary."

During her defamatory campaign, she went as far as to disclose 'B's real name along with sensitive business information, which reportedly led to significant operational challenges for him.


 


Moreover, 'A' extended her accusations by posting six separate instances alleging that 'B' had remarried a woman, referred to as 'C', with whom he purportedly had an extramarital affair.

In a legal twist, back in February 2021, 'A' pursued a lawsuit against 'B' for damages related to alleged sexual assault in the Incheon District Court. However, her claims fell apart due to a lack of evidence substantiating any unlawful conduct.

Throughout the criminal proceedings, 'A' persisted in asserting the validity of her accusations. Nevertheless, the court, referencing the failed lawsuit, dismissed her assertions, highlighting the absence of specific evidence or circumstances corroborating habitual sexual assault by 'B'.

The court further cast doubt on 'A's narratives, pointing out that 'B' had been financially supportive during her international studies and after her return. Her allegations coincided suspiciously with her request for a substantial sum to open a cafe, which 'B' had declined.


Emphasizing the seriousness of the situation, the court stated, "She disseminated false information about the victims due to dissatisfaction with financial denial. The reputations damaged by her actions cannot be fully repaired."


In explaining the rationale behind the sentencing, the court elaborated, "Given the high likelihood of recidivism, as evidenced by her continued dissemination of similar content post-crime, and the victims' fervent plea for stringent punishment, these considerations collectively influenced the judgment."
